Medicare Fee Schedule Rule-Making Process

Each July the Centers for Medicare and Medicaid Services (CMS) posts a "proposed rule" in the Federal Register (a daily publication of the US government that documents proposed and final administrative regulations of federal agencies) laying out their policies for the subsequent year (new and revised) for review by the public. There is a 90-day comment period for interested parties (individuals and organizations) to respond to the proposals. CMS reviews the comments and finalizes the proposals for implementation in what is called the "final rule, " which is typically issued around the first of November for implementation January 1, of the next year.
